An estate plan is the legal process of creating your family’s legacy – ensuring your assets are preserved for your family and are distributed according to your wishes. When the makeup of your family changes, so too should your estate plan.

We recommend reviewing and revamping the following:

Wills

A thoughtfully drafted Will ensures your personal possessions and assets are left to exactly whom you want. It also determines who will care for your minor children in the event that you cannot. This protects your children and helps to avoid a court battle over who should have custody of your children after you pass.

A carefully drafted Will helps provide you with the peace of mind in knowing that your final wishes will be respected; helps to avoid conflict within a family; provides for the safety and security of your loved ones; and saves time and money in court during the probate process.  Also know that if you pass without a Will, which is called intestate, that the Court will pass along your estate to the next of kin according to Massachusetts law.

Health Care Proxy

If you are incapable of making medical decisions, a Health Care Proxy will go into effect. A Health Care Proxy allows you to dictate what care you receive, including life-sustaining treatment. As long as you are deemed competent, you can revoke the proxy at any time.

Durable Power of Attorney

A Durable Power of Attorney permits another person of your choosing to act on your behalf if you are unable to for any reason. This document permits the person or persons you choose to make decisions regarding your finances, taxes, the purchase and sale of property, dissipation of assets, etc. Whether you are incapacitated or unavailable for another reason, a Durable Power of Attorney is a very effective tool.
